Pursuant to the General Data Protection Regulation 2016/679 of the European Parliament and the Council of 27 April 2016, the purpose of this Privacy Policy is to let you know how AGS gathers, processes and protects the personal information of the people who access or make use of its services.

PURPOSES OF PROCESSING PERSONAL INFORMATION

AGS processes the personal data collected in order to manage the relationship, loyalty and service of the customers and persons interested in AGS products, including to make profiles involving the preferences of the data subjects, without having this entail the adoption of automated decisions that have effects on individuals, and to send commercial information on the OSBORNE GROUP, of which the company AGS is a part.

As concerns each of the services currently in place or that may be implemented in the future, users will find in this privacy notice specific information on the processing of the personal data that are requested.

SOURCE OF THE DATA

The personal data collected originate directly from the information offered by the data subjects.

ACCURACY AND TRUTHFULNESS OF THE DATA PROVIDED

The users of the services on the AGS website guarantee and are responsible for the accuracy, validity and authenticity of the personal data provided, and agree to maintain said data properly updated.

STORAGE

The personal data provided will be stored for as long as needed to serve the purposes for which they were collected in order to maintain the relationship or links between the data subject and AGS, and for as long as said subject does not exercise his/her right to erasure or object. They shall also be stored for as long as is required to comply with any legal obligations imposed on the company.

GROUNDS FOR USE. LEGAL BASIS ENABLING THE USE OF THE DATA

The grounds that allow AGS to process the data are based on the terms laid out in Article 6 of the General Data Protection Regulation, pursuant to which the person shall be informed of the bases that provide the legal grounds for processing his/her personal data.

RECIPIENTS

While processing the personal data, AGS will not transfer said data except to the companies that comprise the Osborne Group, which are listed on this website (Osborne Distribuidora, S.A, Bodegas Osborne, S.A., Bodegas Montecillo, S.A., Osborne Selección, S.A., S.R.C Jabugo, S.A., Osborne Restauración S.L. and Grupo Osborne, S.A.), or to comply with a legal obligation imposed on the organization, or with the prior consent of the person, which will be requested when necessary.

The provision of the various services could require the use of transfers to computer services companies acting as data processors for the company, subject to confidentiality and security conditions in their processing of the data. RIGHTS

AGS makes it possible for data subjects to exercise the following rights pertaining to the processing of their personal data:

  • Right to request access to their personal data.
  • Right to request their rectification or erasure.
  • Right to request the restriction of processing.
  • Right to object to the processing.
  • Right to data portability.
  • Right to withdraw the consent given.

Everyone has the right to obtain information on whether AGS processes personal data of concern to them. Data subjects can access their personal data and request that inexact data be rectified or request that they be erased when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, data subjects can request to restrict the processing of their data, in which case they will only be stored for the exercise or defense of legal claims. In certain circumstances and for reasons pertaining to their specific situation, data subjects may object to the processing of their data.

In these cases, AGS will stop processing the data, save for overriding legitimate reasons or for the exercise or defense of legal claims.

A data subject who has granted consent for a specific purpose has the right to withdraw their consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
